FLOOR ACTION:

HF 2294 relates to the distribution of moneys from the disaster aid individual assistance grant fund. A recipient of grant funding will receive reimbursement for expenses upon presenting a receipt for an eligible expense or will receive a voucher through a voucher system administered by the Department of Human Services (DHS). The voucher system is required to ensure sufficient data collection to discourage and prevent fraud. DHS is required to consult with long-term disaster recovery committees and disaster recovery case management committees in developing a voucher system. The Senate adopted an amendment for DHS to develop the voucher program, but the voucher program is administered locally within the designated disaster area. [3/11: 48-0]

HF 2487 requires the Iowa Finance Authority (IFA) to provide written notice to each county and large municipality of the amount of the recovery zone bond allocation designated for each county and large municipality under the federal American Recovery and Reinvestment Act (ARRA) of 2009. Each county or large municipality that issues recovery zone bonds is required to provide a written notice of each such issuance to IFA. IFA is required to track the amount of the recovery zone bond allocation used by each county and large municipality. A county or large municipality may, at any time prior to July 1, 2010, waive all or a portion of its recovery zone bond allocation. Any portion of a county or large municipality’s recovery zone bond allocation that remains unused on July 1, 2010 is deemed waived. IFA is required to recapture those waived portions of the allocations.

On or after March 1, 2010, any eligible issuer may apply to IFA requesting an allocation from the amount of waived recovery zone bond allocations recaptured by the authority. IFA is authorized, on or after April 1, 2010, to reallocate the amount recaptured. IFA is required to promulgate rules to implement the provisions of the bill. HF 2487 takes effect upon enactment. FLOOR ACTION

SF 2316 makes changes regarding the management of flood plains and storm water practices in a watershed. The legislation, as amended in committee, addresses regulations regarding what is commonly referred to as the 500-year flood plain and provides for the development of a model ordinance for local governments to use when developing their own regulations for the 500-year flood plain. It includes requirements that new construction or substantial modification of critical facilities in the flood plain, as defined in the bill, be done to maintain the operation of or provide for the safe cessation of operations during two-tenths percent flood event. The bill also includes provisions relating to the development of storm water runoff best management practices and the review of standards for soil and water conservation practices. Additionally, it authorizes watershed management demonstration projects and multipurpose wetland programs to develop practices for the effective management of storm water in the watershed. FLOOR ACTION

SF 2265 is proposed by the Rebuild Iowa Office and is a recommendation from the Rebuild Iowa Advisory Commission. Highlights include:

• Establishing smart planning principles. State agencies, local governments and other public entities are required to consider and may apply the principles during planning, zoning, development and resource management decision.

1. Smart planning principles encourage collaboration with other groups; identify the importance of efficiency, transparency and consistency; advise the use of clean and renewable energy; advise the use of energy-efficient and sustainable design options; encourage occupational, transportation and housing diversity; encourage revitalization; identify the importance of community character; and encourage decisions that will protect natural and agricultural resources. 

• Establishing an Iowa Smart Planning Task Force. The task force is required to submit a report to the General Assembly and the Governor by November 15, 2010. [2/18: 39-7]

SF 2317 authorizes the creation watershed management authorities, which would be formed by an agreement between two or more political subdivisions within a watershed under Chapter 28E of the Iowa Code. These authorities would consist of political subdivisions located within the same watershed. Political subdivisions within a watershed where a management authority has formed would not be required to joint the authority, and it is not required that a watershed management authority be formed. The authorities would help identify and manage flood risk and water quality issues in that watershed when they cannot be addressed by a single political subdivision.

The watersheds targeted for organization by this bill are those designated by the U.S. Geologic Survey as hydrologic unit code 8 watersheds, of which there are 57 in the state of Iowa. These watersheds generally consist of the land area that forms a watershed for a river. [2/18: 48-0]

HF 2422 is proposed by the Rebuild Iowa Office. The Rebuild Iowa Office and the Department of Human Services are required to work with nonprofit, voluntary and faith-based organizations active in disaster recovery and response in coordination with the Homeland Security and Emergency Management Division of the Department of Public Defense to establish and coordinate a statewide system of disaster case management. The disaster case management system would be activated following the Governor’s proclamation of an individual assistance disaster emergency of a Presidential disaster declaration. A Business Disaster Case Management Task Force is created to research disaster recovery case management assistance needed for businesses following a major disaster. The task force is required to submit their recommendations by November 15, 2010. [2/23: 50-0]
